Depending on the state you are in, yes you still can make a claim. If you are in California then you got a problem. They have laws that make it very difficult for uninsured people to get paid for injury claims.

By the way no need to sue right away. You “make a claim” to the other guys insurance company, if its allowed. They will tell you what you are allowed to collect on and how it will work.

And go buy some insurance.

You should be able to make a claim for your medical expenses. But in California if you don’t have liability coverage yourself then you cannot sue for pain and suffering losses. Lawyers are most interested in representing people with “pain and suffering” losses since these are the big dollar settlements.

Don’t bother with getting a lawyer or suing the insurance company unless they give you a hard time about paying for medical expenses directly related to your accident injuries.
